General

Piening GmbH (hereinafter referred to as "We" or "Piening Personal"), as the operator of the online offer, is the responsible entity for the processing of the personal data of the users of the online offer. Our contact details can be found in the imprint of the online offer, the contact persons for questions on the processing of personal data are mentioned directly in this privacy policy. The terms "applicants" and "users" used in this text include persons of any gender. They are used solely for readability.
The protection of personal data is a high priority for us. We collect, store and use your personal data only in accordance with the content of these data protection regulations and the applicable data protection regulations, the European General Data Protection Regulation (GDPR) and the national data protection regulations. Therefore, we adhere strictly to the legal provisions on data protection (Federal Data Protection Act (BDSG) and EU-DSGVO). The collection, processing, use and storage of personal data is also subject to the statutory provisions of the Telemedia Act (TMG) as well as to the Employee Lease Act (AÜG).

Personal data / What information do we collect?

Personal data is information about an identified or identifiable natural person. This includes all information about your identity, such as your name, e-mail address or postal address. However, information that can’t be linked to your identity (such as statistical information, such as the number of online users) is not considered personally identifiable information.
You can use our online offer without disclosure of your identity and without providing personal data. We will only collect general information about our online offer. For some of the services offered, however, personal data is collected from you. These data are then processed by us in principle only for using this online service, for providing the desired information. When collecting personal data, only the mandatory data must be provided. In addition, further information may be possible, which is then voluntary information. We point out whether they are mandatory or voluntary. An automated decision-making process based on your personal data does not take place in connection with the use of our online offer.

Processing of personal information / How do we protect your information?

Your information will be stored by us on specially protected servers within the European Union. These are protected by technical and organizational measures against loss, destruction, access, modification or dissemination of your data by unauthorized persons. Access to your data is only possible for a few authorized persons. These are responsible for the technical, commercial or editorial support of the servers.
We provide physical, technical, organizational, and administrative security measures to protect your personal information against loss, misuse, unauthorized access, disclosure, and alteration. These security measures include firewalls, data encryption, physical access restrictions on our data centers, password assignment and use, authorization concepts, and access control privileges.
Your personal data is encrypted and transmitted over the Internet. We use SSL encryption (Secure Socket Layer) for data transmission.
We are committed to the continuous optimization of our security concepts and systems.

Can minors use our services?

Piening Personnel knowingly does not collect information from minors or other persons who are legally unable to use our services and websites. Please contact us if you suspect that we have inadvertently or mistakenly collected information from a minor, so we can delete it without delay; unless we are required by law to keep the data.

Use and transfer of personal data to third parties

The applicant agrees that Piening Personal uses its contact information for establishing contact and maintaining contacts and that all notifications concerning this usage relationship can be sent by e-mail, unless another form is required by law. 

Piening Personal uses the information of the applicant, his personal data, for mediation, the temporary employment or recruitment. For Piening Personal to be able to offer the candidate suitable professional tasks, the personal data of the applicant will be collected, processed and stored for this purpose. These data include at least: name, first name, date of birth, full address, contact details, current professional situation, desired place of employment, availability and career aspirations of the applicant. In addition, Piening Personal requires all the information normally found in a resume for successful placement.

Piening Personal uses the data of the applicant, as far as this is necessary for the establishment and design of the application as well as for the mediation of the activity of the applicant. The applicant agrees to the submission of the application documents to interested third parties. If the data for the stated purposes are passed on to third parties, Piening Personal has no influence on the storage, use or deletion of this data by third parties; any data protection claims are therefore directed against the third party in this case alone. By submitting photos to Piening Personal, the Applicant agrees that Piening Personal will submit them to interested third parties together with the application materials. If the applicant wishes to limit the mediation circle, he must inform Piening Personal.

Piening Personal will keep the data according to the legal regulations even after termination of the application and in addition to the supervisory authority, as far as this is required by § 8 AÜG. Piening Personal will store the data for as long as necessary to complete the application process. Thereafter, the data will be deleted, unless legal provisions oppose or if the applicant has expressly consented to further use. 
In addition, we will not disclose the data to third parties without your express consent, especially for advertising purposes. Your personal data will only be disclosed if you have consented to the data transfer or if we are entitled or obliged to do so due to legal provisions and / or official or court orders.

Access to stored data, deletion of stored data

The applicant is entitled to inquire in writing or by e-mail whether and, if so, which personal data are stored by Piening Personal. Piening Personal will process a request in a timely manner and respond within a reasonable time. The inspection presupposes that the applicant proves his eligibility. This requires the presentation of a proof of identity with a photo. Piening Personal reserves the right to reject the access request if reasonable doubt, e.g. to the identity of the requestor.

If the applicant wishes to delete his stored data, Piening Personal will implement the deletion of the data in such a way that it is no longer possible for Piening Personal to use the data. The deletion in any created backup files is done by Piening personnel within the technical possibilities. Any statutory storage obligations remain unaffected.

Legal basis of data processing

Insofar as we obtain consent for the processing of your personal data, Art. 6 para. 1 lit. a) GDPR as a legal basis for data processing.
Insofar as we process your personal data because this is necessary to fulfil a contract or in the context of a contract-like relationship with you, Art. 6 para. 1 lit. b) GDPR as the legal basis for data processing.
Insofar as we process your personal data to fulfil a legal obligation, Art. 6 para. 1 lit. c) GDPR as the legal basis for data processing.
As a legal basis for the data processing comes further Art. 6 para. 1 lit. f) GDPR if the processing of your personal data is necessary to safeguard the legitimate interests of our company or a third party and your interests, fundamental rights and fundamental freedoms do not require the protection of your personal data.
As part of this privacy policy, we always point out the legal basis on which we base the processing of your personal data.

Data erasure and storage duration

We store your data for as long as necessary for the application process. Thereafter, the data will be deleted, unless legal provisions oppose it and unless the applicant has expressly consented to further use.
We always delete or block your personal data whenever the purpose of the storage is omitted. However, it can also be stored if this is provided for by the legal requirements to which we are subject, for example about statutory retention and documentation obligations. In such a case, we will delete or block your personal data after the end of the respective requirements.

Use of the online offer

Each time you access our online services, we collect the following information about your computer, regardless of your registration: the IP address of your computer, the request of your browser and the time of this request. In addition, the status and the amount of data transferred are recorded as part of this request. We also collect product and version information about the browser used and the operating system of the computer. We keep track of which website accessed the online offer. The IP address of your computer is stored only for the time of use of the online offer and then deleted or anonymized by shortening. The remaining data is stored for 24 months.
We use this data for the operation of the online offer, to detect and eliminate errors, to determine the utilization of the online offer and to adjust or improvements. For these purposes, our legitimate interest in the processing of data according to Art. 6 para. 1 lit. f) GDPR.

Use of cookies

For our online offer - as on many websites - cookies are used. Cookies are small text files that are stored on your computer and that store certain settings and data for exchange with the online offer from us via your browser. A cookie usually contains the name of the domain from which the cookie file was sent, as well as information about the age of the cookie and an alphanumeric identifier. Cookies allow us to recognize the computer and make any presets available immediately. Cookies help us to improve the online offer and offer you a better and more personalized service. This also includes our legitimate interest in the processing of data according to Art. 6 para. 1 lit. f) to see GDPR.
The cookies we use are so-called session cookies, which are automatically deleted after the end of the browser session. Occasionally, cookies with a longer storage period can be used so that your preferences and preferences can be considered even the next time you visit our online service.

Google Analytics

We use Google Analytics for statistical analysis. Google Analytics is a web analytics service provided by Google Inc., 1600 Amphitheater Parkway, Mountain View, CA 94034, USA ("Google"). Google Analytics uses so-called "cookies", text files that are stored on your computer and that allow an analysis of the use of the website by you. The information generated by the cookies about your use of this website is usually transmitted to a Google server in the USA and stored there. We believe due to the protective measures taken (anonymization and the possibility of objection), the processing of data to optimize our online offer as a legitimate interest in the processing of data pursuant to Art. 6 para. 1 lit. f) GDPR is to be regarded.

Retargeting and Remarketing

Retargeting or remarketing refers to technologies in which users who have previously visited a certain website are shown appropriate advertising even after leaving this website. For this purpose, it is necessary to recognize Internet users beyond their own website, for which purpose cookies are used by the respective service providers; In addition, the previous usage behaviour is considered. For example, if a user views certain product, they may later display these or similar products as advertisements on other websites. It is personalized advertising that is adapted to the needs of each user. It is not necessary for this personalized advertisement to be identified beyond the recognition of the user. The data used for the retargeting or remarketing will therefore not be merged with other data. 
We use such technologies to display ads on the Internet. For the delivery of the ads we use third-party providers (for example Facebook). We use, among other things, offers from Google, which allows an automatic display of interesting products for the Internet user. This function is implemented by cookies. The installation of cookies for Google Remarketing and Google AdWords Conversion Tracking can be prevented by a setting of the respective browser software by calling the website www.google.com/policies/privacy/ads/ and changing the corresponding setting. The placement of advertising is our legitimate interest in the processing of data according to Art. 6 para. 1 lit. f) GDPR.

Newsletter

When signing up to our newsletter, your e-mail address will be used for our own advertising purposes until you unsubscribe. You will receive regular information via e-mail on current topics as well as e-mails for special occasions, for example during special promotions. The emails can be personalized and individualized  based on our information about you.

For the registration to our newsletter we use, as far as you did not give us your consent in writing, the so-called Double-Opt-In-procedure, which means we will only send you a newsletter by e-mail, if you confirm to us explicitly, that we should activate the newsletter dispatch. We will send you a notification e-mail and ask you to confirm by clicking on a link contained in this email that you want to receive our newsletter.

Newsletter2Go is used as newsletter software. Your data will be sent to Newsletter2Go GmbH (Nürnberger Straße 8, 10787 Berlin). Newsletter2Go is prohibited from selling your data and using it for purposes other than sending our newsletter. Newsletter2Go is also bound by the provisions of the Federal Data Protection Act and other statutory provisions and acts exclusively on our instructions. The legal basis for processing your data is your consent in accordance with Article 6 para. 1 lit. a) GDPR, if you have expressly signed up for the newsletter. As part of the legal requirements, it may also be possible that you receive our newsletter without explicit consent because you have ordered products or services from and we have received in this context your e-mail address and you have not objected to the receipt of information by e-mail. In this case, the legal basis for our legitimate interest in the transmission of direct mail is in accordance with Article 6 paragraph 1 lit. f) GDPR.

You can freely revoke the granted consent to the collection, use and storage of personal data, in particular the e-mail address and its use for sending the newsletter, at any given time with effect for the future. At the end of each newsletter, there is a link where you can unsubscribe from the newsletter immediately. After receiving your withdrawal, we will no longer use your data for the purpose of sending out the newsletter. You can unsubscribe from the newsletter at any time by e-mail to marketing@pieninggmbh.de.

Application portal

Upon receipt of an application via the applicant portal, your documents will be forwarded to the responsible employees electronically. In the case of a successful application, the transmitted data will be stored for the employment relationship in compliance with the legal requirements. In all other cases, the legal basis for storing your application data is your consent in accordance with. Art. 6 para. 1 lit. a) GDPR.

Contact form

As far as you would like to use the contact form in our online offer, we collect the personal data that you provide in the contact form, name and e-mail address. In addition, we store the IP address as well as the date and time of the request. We process the data transmitted via the contact form exclusively for being able to answer your inquiry or your request. You can decide for yourself which information you submit to us via the contact form. The legal basis for processing your data is your consent in accordance with Art. 6 para. 1 lit. a) GDPR. After the matter has been processed by us, the data is first stored in the event of any queries. A deletion of the data can be demanded at any time, otherwise the deletion takes place after complete completion of the matter; statutory storage obligations remain unaffected.

Social Media

In our online offer you will find links to the social networks Facebook, Google+ and Instagram, the career network Xing, the employer rating platform kununu and the short message service Twitter. The links are indicated by the respective logo of the provider.
Clicking on the links opens the corresponding social media pages for which this privacy policy does not apply. For details of the applicable provisions, please refer to the respective privacy policy of each provider. Before calling up the relevant links, no personal information is transmitted to the respective providers. Your call of the linked page is at the same time the basis for the data processing by the respective providers.

Concerned rights

You have extensive rights to the processing of your personal data. First, you have a comprehensive right to information and may, if necessary, request the correction and / or deletion or blocking of your personal data. You can also request a restriction of processing and have a right to object. You also have a right to data transferability about the personal data you provide us. Revocation of consent and opposition

Once consent has been given, it can be freely revoked at any time with effect for the future. The revocation of consent does not affect the legality of the processing carried out based on the consent until the revocation. The contact person for this is our data protection officer.
If the processing of your personal data is not based on a consent, but based on another legal basis, you can object to this data processing. Their opposition leads to a review and, if necessary, termination of data processing. You will be informed about the result of the review and receive - as far as the data processing is still to be continued - from us more information, why the data processing is allowed.

Complaints

If you believe that the processing of your personal data by us does not comply with this Privacy Policy or the applicable Privacy Policy, you may complain to our Privacy Officer. The data protection officer will then examine the matter and inform you of the result of the test. You also have a right of appeal to a supervisory authority.

Our online offer may contain links to other websites. These links are usually marked as such. We have no influence on the extent to which the linked websites comply with the applicable data protection regulations. We therefore recommend that you also inform yourself about the respective data protection regulations at other websites. 

Changes to the privacy policy

The status of this privacy policy is indicated by the date (below). We reserve the right to change this Privacy Policy at any time with future effect. A change occurs with technical adjustments of the on-line offer or with changes of the data protection legal requirements. The current version of the privacy policy is always available directly from the online offer. You should therefore look at these terms occasionally. If parts or individual formulations of this privacy policy should be ineffective, the remaining provisions remain unaffected.
